End‑User Licence Agreement

1. Agreement

This End‑User Licence Agreement (the “Agreement”) is between you (or the entity you represent) and Domani BV, Sint‑Pietersnieuwstraat 14, 9000 Gent, Belgium, enterprise number BE 0789.221.448 (“Domani”). By requesting beta access, creating an account, or using the Domani application (the “Service”), you accept this Agreement and our Privacy Policy. If you do not agree, do not use the Service.

2. Beta nature of the Service

The Service is provided as a private beta. It is under active development, may contain defects, and may change, be interrupted, or be discontinued at any time. Beta access is personal, non‑exclusive and non‑transferable, and may be revoked at our discretion.

3. Licence and acceptable use

Subject to this Agreement, Domani grants you a limited, revocable licence to use the Service for managing your own (or your clients') Belgian tenancies. You agree not to:

  • use the Service unlawfully or in breach of the rights of tenants or third parties;
  • upload data you are not authorised to process, or use the Service to send unlawful or unsolicited communications;
  • attempt to reverse‑engineer, resell, sublicense or circumvent access controls or usage limits;
  • interfere with the integrity, security or performance of the Service.

4. Your data and responsibilities

You retain all rights to the data you enter. You are responsible for the accuracy and lawfulness of that data and for having a legal basis to process the personal data of your tenants and other third parties. For that data, you are the controller and Domani acts as your processor, processing it only on your instructions and as described in the Privacy Policy. You can export your archive (signed PDFs plus a CSV manifest) at any time.

5. Fees

The Service is free of charge during the private beta. Landlords who onboard during the beta keep their access free for life for the portfolio onboarded during the beta. Any future paid plans will be announced before any charge applies; you will never be billed without prior notice and your agreement.

6. Availability and no warranty

During the beta the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose or uninterrupted or error‑free operation. No service‑level commitment applies during the beta. Domani is a tool and does not provide legal, tax or accounting advice; you remain responsible for compliance with applicable tenancy law.

7. Limitation of liability

To the maximum extent permitted by Belgian law, Domani shall not be liable for indirect or consequential damage, loss of profit, or loss or corruption of data arising from beta use. Nothing in this Agreement limits liability that cannot be excluded by law, including for fraud, wilful misconduct, or gross negligence. Subject to the foregoing, Domani's aggregate liability during the free beta is limited to EUR 100.

8. Term and termination

This Agreement applies for as long as you use the Service. You may stop using the Service and request deletion of your account at any time. We may suspend or terminate access in case of breach of this Agreement or at the end of the beta programme. On termination, your data is held read‑only for 30 days and then deleted on request, subject to legally required retention.

9. Changes

We may update this Agreement as the Service evolves. Material changes will be notified to beta users by email, and the date above will be updated. Continued use after a change constitutes acceptance.

10. Governing law and jurisdiction

This Agreement is governed by Belgian law. Any dispute that cannot be resolved amicably shall be submitted to the courts competent for the judicial district of East Flanders, Ghent division, without prejudice to any mandatory consumer protection rules that may apply.
